Individual letters cannot be TRADEMARKED, but names of orgs can. Also, just because an organization's name is TRADEMARKED, it doesn't mean that another organization can't use it for chapter designation purposes. For example, Delta Zeta the GLO is trademarked, but there are plenty of other GLOs with Delta Zeta as their chapter name/designation.
Usually if two or more groups share a name, the official name is a bit longer, and it's the official name that is registered (e.g. Kappa Alpha Order and Kappa Alpha Society). Sometimes they have some sort of agreement to share the name and other times, all they have in common is the name, and their purpose is very different (e.g. one is a social group and the other is academic)
